Tri-State asks Nitro to help overcome smoking ban

Owners of Tri-State Racetrack & Gaming Center are planning an end run around Kanawha County’s indoor smoking ban.

Dan Adkins, vice president of track owners Hartman & Tyner Inc., plans to meet with officials with the city of Nitro next week about smoking at Tri-State. The track lies inside Nitro city limits.

“We’re going to take whatever remedy, legal or otherwise, to solve this problem,” Adkins said Monday.

Revenue at Tri-State Racetrack is down by $15 million compared with last year, Adkins said. He and company officials blame most of the loss on a countywide smoking ban that went into effect in July 2008.

Nitro Mayor Rusty Casto plans to introduce an ordinance at a town council meeting July 21 that would allow both smoking and non-smoking sections at Tri-State.

“According to [Tri-State's] lawyers, we have the authority to allow smoking at the track,” Casto said.

Casto thinks city council will go along with the proposed ordinance.

“It’s cost us $100,000 a year not to allow smoking at the track,” he said.

When track owners were asking Kanawha County voters to approve casino-style table games at Tri-State in 2007, Adkins said he would go along with the county smoking ban. But that was before revenue started dropping at the track. He said the smoking ban is costing Tri-State, Nitro, Kanawha County and the state money.
“What we said was, as long as we’re treated fairly, as long as we’re all treated the same, we would go along with it,” Adkins said. But, he said, the county smoking ban is not being enforced equally.

In addition, bingo halls are allowed to have smoking sections under state law. At least three places in Kanawha County are registered to run bingo games, said Kanawha County Commission President Kent Carper.

Adkins said video lottery revenue is down 6 percent countywide, but is up 12 percent in neighboring Putnam County. He said the figures prove gamers are just taking their business next door, where they can legally smoke.

Adkins said Tri-State is the only one of the state’s three casinos that does not allow smoking. While revenue is down at the other tracks as well, the losses are worse at Tri-State, he said.

Opponents say Tri-State’s revenue losses are due more to a bad national economy and management problems than the smoking ban.

Adkins doesn’t believe the Kanawha-Charleston Health Department can legally regulate smoking at Tri-State. If necessary, he’ll go to court to find out.

“I don’t want to,” Adkins said. “I don’t think it’s the proper way to handle this. But I’m prepared.”
