E-cigarettes in United States goes to federal court

Smoking everywhere, the largest distributor of electronic cigarettes in United States has recently been busy having to defend itself in a class action legal case in federal court, several days after it finished telling a judge in another lawsuit that the existence of the company was under jeopardy due to an increasing amount of legal proceedings, that included one which e-cig seller blamed directly on Action on Smoking and Health (abbreviated as ASH), the powerful anti-tobacco foundation that filled a lawsuit on charges of distribution of unregulated nicotine delivery device.

Electronic cigs have been prohibited in Israel, Australia, Canada and Brazil, restricted in Malaysia and Finland, banned in Oregon and impended with legal proceeding by Connecticut Attorney general and even removed from, Facebook and Paypal after the latter companies got notifications from Action on Smoking and Health, warning them of likely judicial liability.

The legal actions were triggered when the US Food and Drug Administration have revealed a report about hazardous toxins and carcinogens contained in the devices and potentially inhaled by consumers and passersby.

According to the latest lawsuit, the defendant states that his goods have undergone toxicological tests which proved that the products don’t contain any cancer-causing substances. But, the plaintiff claims that the electronic cigarettes have been found to contain carcinogens and one sample even had diethylene glycol inside, which is poisonous chemical used in antifreeze and related to many cases of deadly poisonings in various corners of the world from spoiled cough syrup and toothpaste.

The plaintiff cites the notorious cases when cough syrups and toothpastes and manufactured in China were tested positive for presence of fatal substance diethylene glycol. The overwhelming part of electronic cigarettes selling across America is also manufactured in China.

Besides diethylene glycol, the FDA experts have reported to find in cartridges of the tested electronic cigarettes cancer-causing nitrosamines, and other toxic substances, including anabasine, nicotyrine and myosmine, all known to be linked with severe health complications.

Robert Janssen, professor of Public law at North Carolina State University believes that more civil legal actions are possibly to be submitted very soon, whereas the distributors of drug products which have not been regulated by the FDA are like to face criminal charges, although they didn’t make any statements for their goods.

The majority of other nicotine-replacement therapies, like patches, gums, sprays, candies and the a device called “Favor”, which looks like a cigarette and as well delivers nicotine, are approved by the FDA, which generally demands health warnings and implements other restrictions, including sales limitations in order to protect public health.

But, the electronic cigarettes have not been approved, and don’t bear any health warnings. They are sold everywhere and thus, are easily accessible for children, and even come in tasty flavors; which is claimed by the public health groups to be the major gateway for picking them up by minors.

Prof Janssen thinks that if people want to have a shot of nicotine by inhaling it, they can make use of nicotine inhalers, which look like cigarettes and are safe for consumption.
Maybe electronic cigarettes will be approved by the FDA one day, but only if they would be proven to be safe and contain no hazardous additives, said Prof. Janssen.

    Electronic Cigarettes MUST BE BANNED. Especially during this time of RECESSION, states (and the federal government) are not able to make their budget… smokers switching over to these vaporizing devices are NOT included under tobacco taxes.

    Also, pharmaceutical companies will stand to loose profits off their quit-smoking aids since electronic cigarettes have a higher success rate of reducing or eliminating regular cigarettes. Nicotine gums and such are very profitable because people have to keep buying them again given their poor success rate. Since people can continue to vaporize regularly while they slowly reduce nicotine, that separates nicotine from the oral fixation making repeat buys minimal.

    No one currently needs a prescription for nicotine right now, which should change so that people can support their local doctor’s office to get a prescription.

    Obviously this will also impact tobacco companies, who risk losing their monopoly on nicotine, since that is really what people want when they smoke a cigarette (they aren’t doing it for the smoke). We should also BAN EGGPLANT and a handful of other vegetables since they also contain nicotine.

    And we all know health care needs to be better funded… we could lose that funding as fewer people find themselves being diagnosed with lung cancer and other smoking related illnesses — chemo therapy is worth quite a bit and help our economy in many ways, a dramatic reduction could cripple our industry.

    And LIKE THE ARTICLE STATES: THINK OF THE CHILDREN! All these tasty flavors are obviously marketed towards CHILDREN! Even though children probably aren’t carrying around 100 dollars for an e-cig kit to buy over a regular pack of smokes, it certainly sounds moral to say since one must over look the millions of lives it can save.

    So as you can see, there are clearly MANY reasons the FDA and states should ban these devices. We MUST get the word out about how bad these are now before they catch on.

    LOL!! I love the previous comment. My point exactly! The only reason there banning and making such a big deal over electronic cigarettes is because they wont get their tax money or moneys to go for there over priced cigaretts and quiting devices. We all know by now that e-cigs are healthyer than a normal ciggerette because normal ones have over 400 chemicals in it that can kill you. So they found one or two things in a e-cig that might be harmful, Big woop. One or two is a heck of a lot better than 400. LOL If its such a big deal.. then why don’t they ban the sale of regualar cigaretts?? Why wont they??.. hmmm.. read the previous Its all about money people.. thats it. They don’t care about our health.. they just want to do whats right for moneys sake.
    Oh.. one more thing.. To those people who are claiming that cig companies promote to children.. Hello! I love chocolate and mint flavors, and cookies without the calories?.. oh heck I’m 28 not 8 and i love it. Their just using that as an excuse to get other non smokers to believe that cigarette companies and e-cig companies are out to get there children. LOL please. Any good parent would keep there kids away from them anyway let alone let them have enough money to buy these products. An e-cig starter kit ranges from 60-200 bucks. Now.. you tell me.. Do you give your child under 18 that amount of money.. OH HECK I know i don’t.

    I have used the e-cigarette for 3 months and feel 100% better. My CBC(complete blood count) is normal now and my stamina has increased considerably. No coughing,congestion or other respiratory problems. This will literally kill me if they ban the
    duo e-cigarette. This is the first thing that has helped me. Patches,gum,antismoking drugs do not help. This seems the best solution for me and others.

    Sam and Lucke… what a terrible point of view. Our government can spend money as they please and you feel smokers should pay for it? Wow.

    I’ve been using e-cigs for almost a year and my lung function is infinitely better, I’m at reduced risk of cancer, and there’s no more secondhand smoke. How can you deny me this over MONEY?

    The marketing of these is not aimed at kids. Heads up, tobacco tastes like shit. After getting off cigarettes, many people who use electronic cigarettes go for a different flavor. I myself enjoy blueberry, banana, and redbull, and always keep menthol around.

    But yes, it seems like the FDA would have a hard time placing a tax on these since they do not contain tobacco. I’ve stopped smoking regular cigarettes and switched to e-cigarettes. I didn’t do it because of the cost or the insane taxes in my state, but because of the health benefits. I feel much better after making the switch, and will gladly recommend the device to my friends. The one that I use has a total of four ingredients in the nicotine cartridges. Nicotine, water, flavoring and propylene glycol.

    Look, ma! No carcinogens! =P

    Kody read his whole response he was being as Sarcastic as possible and you people still don’t get it. I am now 8 days tobacco free and don’t want an Analog Cigarette. The E-Cigarette is the BEST investment i have ever made. We have 12 people where i work who have quit analogs for the e-cigs. I am suggesting this to everyone i meet that smokes.

Population control has always been a big issue and ciggs kill enough people to help keep this problem a little more under control while they line thier pockets with money from the sick and dying everyone trying to ban e-ciggs are fucking Murderers they are killing good people that got sucked into a habit that now they cant quit. I smoked for seven years and i have been smoke free for 2 years thanks to e-ciggs even my doctor has told me that my lungs have cleared up ten fold so take that to fucking court you dumb little bitches

    FIRST and foremost The device,should NOT be called an e cig !!

    It is a PV= Personnel Vaporizer. Associating it with a cigarette is not justice.

    With out this device, my wife and I would still be smoking “death sticks”.

    WITH this device,neither of us has had a cigarette in 6,yes SIX MONTHS.

    We tried-patches,gum,prescriptions,which is poison,and even hypnosis. Guess what.?.? NOTHING WORKED……Until…we ordered our very own PV=Personal Vaporizer from for a whopping 35.00 dollars.

    Go ahead ban em, and you that ban em can be responsible for the deaths you allowed to happen !!!!!!!!
